Navigating California's Workers' Compensation

This post was updated on 11/08/2024

Are you struggling to make ends meet after a work-related injury? You're not alone. The reality is, that California's workers' compensation system often falls short in providing adequate financial support to injured workers. At Pacific Workers’ we frequently see cases of previous injuries. Let's delve into why workers' comp benefits are so low and what options you must ensure you receive the reward you earn.

Navigating California's Workers' Compensation

Temporary Disability Benefits

Permanent Disability Compensation

Temporary disability benefits replace a portion of your pre-injury wages, typically amounting to two-thirds of your average weekly wage. However, you can find minimums and maximums in place. Also, many injured workers receive less than they need to cover their expenses. If you suspect your benefits are inaccurate, seek lawful advice to ensure compensation. We can help you determine if your benefits are accurate, and if you're being compensated correctly.

Unlike temporary disability benefits, which aim to offset lost wages, permanent disability benefits compensate for the lasting impairment caused by the injury. It's common for injured workers to receive permanent disability benefits while still working, as these benefits are not considered a wage offset. However, many find that these benefits are insufficient to maintain their standard of living.

Exploring Alternative Benefits

In cases where workers' comp benefits are inadequate, exploring alternative forms of assistance becomes essential. While navigating various benefit programs can be complex, options such as State Disability Insurance, Unemployment Insurance, and Social Security Disability may provide additional financial support.
