4 Reasons Your Workers’ Comp Disability Payments Stopped
Workers’ Compensation can be very difficult to navigate through especially if you are not familiar with the system. Often times, California Employers do not provide an injured worker with sufficient information about their workers’ compensation benefits and leave it to the insurance companies to pass on the information. Unfortunately, this can be of no help for the injured worker. When an injured worker wants to figure out if he or she is owed temporary disability benefits they can be left in the dark in regard to the information.
Here are a few reasons why Workers’ Comp Disability Payments can be stopped.
Reason #1- Your doctor has released you from Medical Treatment or with restrictions your employer can accommodate.
Reason #2- Your treating physician, or a Qualified Medical Evaluator (QME) has declared your condition “Permanent and Stationary.”
Reason #3- You have received 104 weeks of temporary disability benefits.
Reason #4- You are a Seasonal Worker and the reported season has ended.
These are just a few reasons as to why you may no longer get disability payments and therefore are no longer entitled to these benefits. If the Insurance Company stops your Disability Payments, contact your claim adjuster or your attorney, if represented immediately and find out why.
If your claim has been denied, or if you have reached your 104 weeks but are still unable to return to work, you may be able to apply for State Disability Insurance Benefits, you can do so in the following ways:
- Appear in person at your local EDD office.
- Contact your localEDD office via telephone.
- Apply for Benefits online at the EDD’s website: https://www.edd.ca.gov/disability/This is also the quickest way.
